began in the late 1980s in the former USSR gave hope for a better future to the Chechen people. It was during this period that a rapid process of spiritual growth of the Chechens began, that a sense of national identity grew, and that the first concepts of the further political development of the Chechen-Ingush Republic along the path of independence appeared.<\/p>\n<p>In April 1990, the Supreme Soviet of the USSR, which was the supreme authority in the country, adopted two laws which were fateful for the peoples of the USSR: on 10 April, the \u201cLaw on the Basis of Economic Relations of the USSR, the Union and Autonomous Republics\u201d; and on 26 April, the \u201cLaw on Delimitation of Powers Between the USSR and Subjects of the Federation\u201d. Beside the general provisions in these laws, there were two articles which radically changed the status of autonomous republics. Their rights were raised to equivalence with those of the Union republics. The law of 26 April, Article 1 states that Autonomous republics, like the Union republics, are subjects of the federation. On 27 November 1990, the Supreme Soviet of the Chechen-Ingush Republic, at the request of the Supreme Soviet of the USSR, adopted a Declaration of State Sovereignty, which signified the republic\u2019s withdrawal from the structure of the RSFSR. Before the August putsch of 1991 in Moscow, the Chechen-Ingush Republic had existed for approximately one year as a Union republic, recognized by the laws of the USSR and Russia as an equal subject of the USSR, which allowed it to become an independent state after the collapse of the USSR, as was the case with the fifteen Union Republics of the USSR.<\/p>\n<p>Thus, the declaration of the sovereignty of the Chechen Republic was in accordance with the stipulations and legally grounded in the adoption of a number of new laws by the USSR in April 1990 and was absolutely legitimate in terms of the then Soviet and Russian legislation, as well as in international law.<\/p>\n<p>On 27 October 1991, presidential and parliamentary elections were held in the Chechen Republic. In these elections, Dzhokhar Dudaev won a decisive victory and, by his first presidential Decree, confirmed the previous resolutions of the Supreme Council of the Chechen-Ingush Republic on state sovereignty. All these events occurred before the dissolution of the USSR.<\/p>\n<p>From this it follows that, on 1 November 1991, the Chechen people and the freely elected leadership of Chechnya legally formalized the creation of an independent state \u2013 the Chechen Republic.<\/p>\n<p>As we see, the founding of the sovereign Chechen state followed the path of legality, observing the requirements of both Soviet and Russian laws, and of international law. Russia initially agreed with the independence of the Chechen Republic, but the existence in Russia of an imperial syndrome, of great-power chauvinism and totalitarianism led, first, to a policy of attempting to asphyxiate Chechnya through political, economic and financial isolation and blockade and, when that did not succeed, in December 1994 Russia launched a full-scale war against the Chechen Republic. This lasted almost twenty years and claimed the lives of 300,000 civilians of the Chechen Republic, including more than 40,000 children. Against Chechnya, a country small in terms of territory and population, Russia used weapons of every kind, including weapons prohibited by international conventions, as well as some300,000 of its troops, from strategic aviation to marines. Cities and villages were reduced to ruins, the ecological balance was disrupted, and hundreds of thousands of people, deprived of their homes and normal living conditions, became refugees.<\/p>\n<p>Below are the statistics behind the facts, events and realities which have arisen in the Chechen Republic as a result of the two Russian wars, begun in 1994 and 1999:<\/p>\n<ol>\n<li>About 300,000 citizens of the Chechen Republic have been killed.<\/li>\n<li>About 400,000 citizens, have became refugees.<\/li>\n<li>Hundreds of thousands of Chechens have been crippled by war, including tens of thousands of children.<\/li>\n<li>Tens of thousands of children have been wholly orphaned.<\/li>\n<li>The physical and mental health of the nation has been undermined.<\/li>\n<li>Massacres of Chechens were implemented through massive bombing and artillery bombardments, and through shootings.<\/li>\n<li>All higher education institutions were completely destroyed, along with their material and technical resources; the buildings of all schools, polytechnics and colleges were destroyed.<\/li>\n<li>There has been total destruction of hospitals, museums, archives and libraries.<\/li>\n<li>Irreparable damage has been caused to the flora and fauna, and the ecology of the region has been violated.<\/li>\n<li>Russian air power, tanks and heavy artillery destroyed cities and villages, devastating the economy and infrastructure.<\/li>\n<li>On the territory of the Chechen Republic of Ichkeria occupied by the Russian army, during two wars, more than thirty \u2018filtration\u2019 camps were created, which were in reality extermination factories for Chechens, where the punitive organs of the Russian military perpetrated acts of sadistic torture, rape, beating, abuse, degradation and executions of Chechen men, women, children and the elderly. The actual numbers of these victims are colossal.<\/li>\n<li>A major part of the territory of Chechnya was mined, which is why civilians, especially children, suffered and continue to this day to suffer from explosions.<\/li>\n<li>More than 5,000 people are missing without trace.<\/li>\n<li>More than 20,000 guiltless Chechens, mostly young, have been arbitrarily detained by the Russian authorities and have been languishing in prisons in Russia for more than 20 years.<\/li>\n<li>The population of Chechnya has been subjected to diabolical suffering as a result of incessant Russian bombing and shelling.<\/li>\n<li>Refugees from the Chechen Republic of Ichkeria have been living for years in appalling conditions in tented camps in Ingushetia.<\/li>\n<li>Throughout the territory of Russia, Chechens have been persecuted on racial grounds, arrested, tried on trumped-up charges, and held in custody without trial or investigations.<\/li>\n<li>The Russian political-military leadership, Russian propaganda and mass media have demonized the Chechen people, humiliated, disparaged and defamed them.<\/li>\n<\/ol>\n<p>In the spirit of the times of the Bolshevik-Communist regime, the Russian special services staged numerous provocations against the Chechen people and the leadership of the Chechen Republic of Ichkeria. Without any reason, these authorities blamed the Chechen leadership and the entire Chechen people for aggression and international terrorism.<\/p>\n<p>Despite the fact that on 12 May 1997 the Chechen Republic of Ichkeria and the Russian Federation signed a peace treaty at presidential level, under which both parties undertook to end their 400-year confrontation and to found their future relations on the principles of international law, the Russian leadership, the Russian special services and false propaganda machine were intensively preparing the ground for a new war against Chechnya, which began in September 1999.<\/p>\n<p>Russia and the USSR, and the punitive bodies they established, have committed the following grave crimes against the Chechen people:<\/p>\n<ol>\n<li>Russian expansion in the North Caucasus and the aggressive, colonial war of Russia in the 18th and 19th centuries against the peoples of the North Caucasus, which lasted for more than 100 years, took the lives of some 90% of the Chechen population.<\/li>\n<li>The repressions of the Bolshevik-Communist regime of the USSR in the 1920s and 1930s took the lives of 35% of the entire Chechen population.<\/li>\n<li>Bolshevik-Communist forcible deportation of the Chechen people on 23 February 1944 to Central Asia, Kazakhstan and Siberia, with aggravating consequences, caused the deaths of some 70% of the Chechen population.<\/li>\n<li>The murder of 300,000 people, including more than 40,000 children, as a result of the Russian aggression in 1994 and 1999.<\/li>\n<li>Destruction of the homes of the Chechen people.<\/li>\n<li>Total destruction of the historic and cultural treasures of the Chechen people.<\/li>\n<li>Total destruction of the economy and infrastructure of the Chechen Republic.<\/li>\n<\/ol>\n<p>In this way the regimes in Russia, Tsarist, Communist, and the current pseudo-democratic regime, set themselves the goal of physically and morally destroying the Chechen people. Chechnya without Chechens \u2013such is Russia\u2019s aim.<\/p>\n<p>The policy of the Russian state towards the Chechen people is proof of the longevity of the perfidious, misanthropic, chauvinistic, imperial ideology which is so deeply rooted in Russia. Its ideology, professing military aggression, violence, nationalism, racism and chauvinism, can once again plunge the world into the chaos of war. All of the above is irrefutable testimony to the commission by Russia of the gravest crimes against the very existence of the Chechen people, an ancient, indigenous people of the Caucasus with its own territory, millennial history, spiritual and material culture.<\/p>\n<p>The humanitarian catastrophe in Chechnya caused by Russia\u2019s great-power ambitions has demonstrated the absence of moral principles in the way the world\u2019s powers apply the human rights norms of international law. The international community, and primarily the United Nations, has not shown due resolve in the matter of defending Chechnya against Russian aggression, describing full-scale wars and wholesale crimes against humanity as an \u201cinternal affair of Russia\u201d. The Russian authorities remain unpunished for the crimes they have committed against the Chechen people, and they continue to commit new crimes, now in Ukraine, Georgia and against other countries of the world. They pose a major threat to the global community.<\/p>\n<p>With the aim of obtaining a just examination of the crimes Russia has committed in Chechnya and of averting a new escalation of the war, we, representatives of public organizations of the countries of the European Union, appeal to you to lay the foundations for a hearing in the International Criminal Court to consider war crimes committed by Russia\u2019s political and military forces against the Chechen people and Chechnya. We are convinced that the goodwill of the international community is an essential tool not only for defending peace, the rule of law, and protecting human rights and freedoms, but that it can also prove a decisive factor in restoring justice to the Chechen people.<\/p>\n<p>In this connection, we urge you to place this issue on the agenda of the UN Security Council, and to create a commission to conduct an independent inquiry into Russian war crimes committed on the territory of the Chechen Republic between 1994 and 2019, and to establish an International Tribunal with the aim of bringing to justice Russia\u2019s military-political criminals.<\/p>\n<p>The establishment of an international commission to investigate war crimes in the Chechen Republic will be an important step aimed at averting possible subsequent aggressive actions by Russia against sovereign states.<\/p>\n<p>Crimes against humanity do not have a statute of limitations. Kafkasya\u2019n\u0131n otokton halklar\u0131ndan olan, binlerce y\u0131ll\u0131k tarihi ve k\u00fclt\u00fcr\u00fc ile kendisine ait olan topraklarda ya\u015fayan \u00c7e\u00e7en halk\u0131n\u0131n varl\u0131\u011f\u0131na kar\u015f\u0131 i\u015flenmi\u015f ve yukar\u0131da maddeler halinde say\u0131lm\u0131\u015f t\u00fcm bu ciddi su\u00e7lar, Rusya\u2019n\u0131n ger\u00e7ekte nas\u0131l bir yap\u0131 oldu\u011funun reddedilemez birer kan\u0131t\u0131d\u0131r.<\/p>\n<p>Rusya\u2019n\u0131n b\u00fcy\u00fck g\u00fc\u00e7 olma arzusunu ger\u00e7ekle\u015ftirmek i\u00e7in \u00c7e\u00e7enya\u2019da neden oldu\u011fu insani felaket d\u00fcnyan\u0131n \u00f6nde gelen g\u00fc\u00e7lerinin evrensel insan haklar\u0131 normlar\u0131n\u0131 ve ahlaki prensipleri istedikleri gibi yorumlayabildiklerini g\u00f6stermektedir. Ba\u015fta Birle\u015fmi\u015f Milletler olmak \u00fczere, uluslararas\u0131 toplum \u00c7e\u00e7enya\u2019y\u0131 Rusya\u2019n\u0131n sald\u0131rganl\u0131\u011f\u0131ndan korumak i\u00e7in herhangi bir \u00e7aba g\u00f6stermedi ve t\u00fcm g\u00fcc\u00fcyle seyreden bu sava\u015f\u0131, insanl\u0131\u011fa kar\u015f\u0131 i\u015flenen su\u00e7lar\u0131 \u201cRusya\u2019n\u0131n i\u00e7 meselesi\u201d olarak adland\u0131rd\u0131. \u00c7e\u00e7enya\u2019da i\u015fledi\u011fi su\u00e7lardan \u00f6t\u00fcr\u00fc cezaland\u0131r\u0131lmayan Rus liderli\u011fi de, G\u00fcrcistan\u2019da, Ukrayna\u2019da ve d\u00fcnyan\u0131n ba\u015fka yerlerinde yeni su\u00e7lar i\u015flemeye ba\u015flayarak t\u00fcm d\u00fcnya i\u00e7in ger\u00e7ek bir tehdit olu\u015fturmaya devam etti\u011fini g\u00f6sterdi<\/p>\n<p>Rusya\u2019n\u0131n \u00c7e\u00e7enya\u2019da i\u015fledi\u011fi su\u00e7lar\u0131n adilane bir \u015fekilde ara\u015ft\u0131r\u0131labilmesi ve yeni sava\u015flar\u0131n engellenebilmesi i\u00e7in, Avrupa Birli\u011fi\u2019ndeki sivil toplum kurulu\u015flar\u0131n\u0131n temsilcileri olarak sizden Rus siyasi ve askeri liderli\u011finin \u00c7e\u00e7enya\u2019da \u00c7e\u00e7en halk\u0131na kar\u015f\u0131 i\u015fledi\u011fi su\u00e7lar\u0131n de\u011ferlendirilmesi amac\u0131yla Rusya\u2019n\u0131n Uluslararas\u0131 Ceza Mahkemesi\u2019nde yarg\u0131lanabilmesinin temellerini atman\u0131z\u0131 istiyoruz. Uluslararas\u0131 toplumun iyi niyetinin sadece bar\u0131\u015f\u0131 korumak i\u00e7in de\u011fil, ayn\u0131 zamanda hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc, insan haklar\u0131 ve \u00f6zg\u00fcrl\u00fcklerin korunmas\u0131 i\u00e7in ve \u00c7e\u00e7en halk\u0131n\u0131n bekledi\u011fi adaletin sa\u011flanmas\u0131nda da belirleyici bir fakt\u00f6r olabilece\u011fine inan\u0131yoruz.<\/p>\n<p>Bu bak\u0131mdan, 1994\u2019ten 2019 y\u0131l\u0131na kadar \u00c7e\u00e7en Cumhuriyeti topraklar\u0131nda Rusya\u2019n\u0131n i\u015fledi\u011fi sava\u015f su\u00e7lar\u0131 hakk\u0131nda ara\u015ft\u0131rma yapmak \u00fczere ba\u011f\u0131ms\u0131z bir komisyon olu\u015fturulmas\u0131 ve bu su\u00e7lardan sorumlu Rus askeri-siyasi liderli\u011fini yarg\u0131lamak \u00fczere uluslararas\u0131 bir Ceza Mahkemesi\u2019nin kurulmas\u0131 konusunu BM G\u00fcvenlik Konseyi\u2019nin g\u00fcndemine alman\u0131z\u0131 \u015fiddetle talep ediyoruz.<\/p>\n<p>\u00c7e\u00e7en Cumhuriyeti\u2019nde i\u015flenilen sava\u015f su\u00e7lar\u0131n\u0131n ara\u015ft\u0131r\u0131lmas\u0131na y\u00f6nelik uluslararas\u0131 bir komisyonun kurulmas\u0131, Rusya\u2019n\u0131n gelecekte ba\u015fka ba\u011f\u0131ms\u0131z devletlere y\u00f6nelik ger\u00e7ekle\u015ftirebilece\u011fi muhtemelen sald\u0131rganl\u0131klar\u0131 engellemenin \u00f6nemli bir ad\u0131m\u0131 olacakt\u0131r.<\/p>\n<p>\u0130nsanl\u0131\u011fa kar\u015f\u0131 i\u015flenmi\u015f su\u00e7lar i\u00e7in herhangi bir yasal k\u0131s\u0131tlama olamaz.
